INFORMATION

Legal terms

Last updated: . Contract version: FD-2026-10-16-3.

FiestaDigital is managed by Yasmina Rodríguez González. The portal introduces the service and lets you create an account, request digital spaces for festivals and events, and manage requests and subscribed services.

Locality: Oviedo, Asturias.

Organisers’ sites may have their own legal and privacy information depending on their content and features. These terms govern the portal and service relationship with FiestaDigital.

The service provides access to a hosted platform for managing festivities websites: venues and menus, shops and items, agenda activities, promotions and banners, according to the plan and additional services contracted. Custom design, content entry and other professional services are included only when expressly stated in the offer.

2. Account and permitted use

Personal space access requires Google, Microsoft or email verification. Users must provide accurate details, keep them up to date and protect their login methods. Anyone acting for an organisation must have sufficient authorisation.

Impersonation, accessing others’ accounts, disrupting service or illegal activities are prohibited. Unauthorised account use must be reported for review.

2.1. ChatGPT and other assistants through MCP

Connecting to ChatGPT, provided by OpenAI, or another MCP-compatible assistant is optional. It allows the assistant to view, create, edit or delete FiestaDigital content within the permissions granted. Through OAuth you choose the sites and editions and accept or reject the requested permissions; manual tokens are managed in the site's AI Agents section. Access is checked for each operation.

Check the destination, instructions and results: the assistant may make mistakes. Creating content through MCP produces drafts; editing published content may return it to draft, and deleting it may remove it from the website. MCP does not publish banners or promotions, enter into advertising contracts, initiate payments, confirm incoming payments or grant exemptions. Contracting and publication take place in the panel under its terms.

Only send information that you are authorised to use and disclose to the assistant's provider. Do not include passwords, keys, bank details, identity documents, health data or other unnecessary sensitive data in instructions or content. FiestaDigital and the assistant's provider are separate services; this connection does not imply OpenAI's endorsement of FiestaDigital.

3. Requests and subscription

Saving a request means neither payment, approval, definitive subdomain reservation nor site activation. Availability and service conditions must be confirmed before subscribing.

Before subscribing, the plan, features, limits, duration, total tax-inclusive price, extras and activation terms will be provided. Users can review and correct details before confirmation. Subscription requires express acceptance of the applicable terms and confirmation from FiestaDigital in a retainable format.

If a request cannot be accepted and payment was received for a service that will not be provided, the corresponding amount will be refunded.

4. Plans, payment and duration

Each email address can request only one free trial.

Cancelling the request or switching to a paid plan later does not allow you to request another trial.

Plans and limits appear before subscribing. Fees are paid annually unless expressly agreed otherwise. Displayed monthly amounts are annual-fee equivalents, not monthly payments. The final price includes taxes and selected extras; other services require separate quotes and acceptance.

A plan without content quotas does not mean unlimited computing resources. Storage, transfer or other resource limits affecting service must be communicated before subscribing; no hidden material restrictions during the paid period.

Service lasts twelve months from the confirmed start date unless expressly agreed otherwise. Renewal requires acceptance of the next period’s price and terms and the corresponding payment. No automatic charges without specific authorisation.

Customers may decline renewal before the next period begins, without penalty and with service retained through the current paid period. Use only FiestaDigital’s indicated payment methods. Bank passwords and authorisation codes will not be requested for manual payment management.

5. Annual price review

The agreed price remains fixed during the subscribed and paid annual period. Ordinary reviews apply only to the next renewal, without retroactive effect.

FiestaDigital may propose new rates based on CPI changes; demonstrable changes in server, storage, transfer, domain, email and technology supplier costs; maintenance, security and operating costs needed for service; and regulatory or tax changes affecting provision.

If CPI is used, the annual change in the national general index published by Spain’s National Statistics Institute, reference month and calculation will be identified. Other costs will be explained separately without counting increases twice. Reviews are neither automatic nor necessarily the sum of CPI and every supplier increase.

The new total price, reasons and effective date will be communicated at least thirty calendar days before renewal. Customers can accept or reject renewal without penalty. Silence does not accept the new price; without acceptance, service ends at the paid period’s expiry. Tax changes apply as legally required, with information on their impact.

6. Municipal exclusivity

Exclusivity, when offered, is an additional service. Territory, duration, amount, scope, exceptions and pre-existing situations will be specified before subscribing. Submitting a request alone grants no exclusive rights.

Exclusivity grants the customer the exclusive right to register new municipal domains or subdomains to create sites within FiestaDigital in the agreed municipality and for the agreed period, respecting confirmed pre-existing arrangements. It does not grant exclusive rights over the municipality, its festivities, names or activities, nor does it restrict third-party services outside FiestaDigital.

Exclusivity does not confer ownership, registered title or a right to transfer the contracted domain or subdomain. Its use is limited to the contracted service and term. Ownership of customers’ own domains is governed by their registration and specific agreements.

Exclusivity requires keeping payments for the contracted service up to date. Failure to pay for renewal ends exclusivity when the paid period expires; temporarily retaining the site or its data does not extend that right. Other overdue and enforceable unpaid amounts for this service may lead to termination following a payment demand and a reasonable opportunity to remedy the default. Renewal requires accepting the corresponding price and terms.

FiestaDigital may terminate exclusivity and offer the territory again in the event of serious breaches or prolonged inactivity. The grounds for termination and, for inactivity, the specific period and objective criteria must have been communicated and expressly accepted before contracting. Without that prior definition, exclusivity cannot be withdrawn for inactivity. The festivities’ calendar and agreed breaks will be respected.

Before terminating for breach or inactivity, FiestaDigital will communicate the reasons, the proposed effective date and a reasonable period to remedy the situation or submit objections, except in urgent cases or where prohibited by law. Reclaiming the territory allows new contracts within FiestaDigital and does not transfer the customer’s content or ownership of their own domains; legal rights and applicable retention rules will be respected.

7. Content and rights

Customers retain content rights and authorise FiestaDigital to host, reproduce, technically adapt and communicate it publicly solely to provide the service. Ownership is not transferred.

Customers must hold rights to texts, photos, trademarks and other materials, and a valid legal basis for personal data and images, especially minors’. Unnecessary sensitive data must not be submitted. Illegal, fraudulent, discriminatory or rights-infringing content is prohibited.

FiestaDigital may restrict content following legal requirements or well-founded indications of infringement, informing the customer where appropriate and allowing clarification. Organisers are responsible for supplied times, prices, activities and venue details; hosting does not mean FiestaDigital verifies or guarantees their accuracy.

The organiser manages and updates its content and its contributors' permissions. Establishments and advertisers are responsible for their products, services, prices, food information and fulfilment of offers. FiestaDigital is responsible for providing its service and for its own actions; hosting a listing does not in itself make FiestaDigital the seller or organiser of the advertised activity.

Offers and promotions must identify the advertiser, validity period and relevant conditions, including restrictions and availability. Publication does not override consumer rights or replace obligations to provide information about prices, taxes and allergens. The customer must review imported or automatically generated content before publishing it and report any errors found.

Potentially illegal content may be reported using the contact form, specifying its exact location and the reasons for the report. FiestaDigital will handle reports diligently and objectively, communicate its decision where required and provide reasons and complaint avenues when restricting content.

7.1. Advertising managed by FiestaDigital

Unless an advertising-free plan is expressly agreed, the service includes advertising spaces managed by FiestaDigital in the website's templates and public pages. These may display FiestaDigital's own or third-party advertising, identified as advertising and distinguished from editorial content. Its inclusion will respect the essential contracted functions and the terms of paid advertisements.

Revenue from these spaces belongs to FiestaDigital unless otherwise agreed in writing. This advertising may coexist with contracted banners and promotions. Contracting the website does not grant advertising exclusivity, a share of that revenue or exclusion of competitors; any exception must be expressly stated in the accepted offer. Municipal exclusivity does not imply advertising exclusivity.

7.2. Paid banners and promotions

These are additional services to the website fee. Before contracting, the provider and invoicing party, total price including taxes, website and edition, placement or format, start and end dates, rotation or selection criteria and review conditions must be confirmed. An annual rate does not grant indefinite publication or automatic extension: the specific period must be stated in the accepted offer.

Payment does not waive content review or guarantee an exclusive position, continuous exposure on every visit, a number of impressions, clicks or sales, unless expressly guaranteed in the contract. Illegal, misleading content or content infringing third-party rights will not be published. Lack of commercial results alone does not constitute a breach if the agreed advertising service has been provided.

If an advertisement cannot be accepted or published, the amount for the unprovided service will be refunded. For delays, interruptions or removal attributable to FiestaDigital, an appropriate remedy will be offered, which may include agreed rescheduling, an extended period or a refund for the unprovided portion, without limiting statutory rights. Cancellation by the advertiser and subsequent changes will be governed by the accepted offer and applicable law.

8. Availability, support and liability

FiestaDigital takes reasonable measures to maintain service and protect information. Maintenance, technical incidents or supplier failures may cause interruptions. Support features and any specific availability guarantees must appear in the contracted offer.

For incidents attributable to FiestaDigital, we will seek to restore service and apply contractual and statutory remedies and compensation. These terms do not exclude legally enforceable liability or limit consumers’ inalienable rights.

9. Exports, cancellation and suspension

Customers must create and retain their own exports using available means. Internal infrastructure copies are operational, not an archive service or guarantee of individual recovery. This does not exclude FiestaDigital’s statutory security and service obligations.

Export of the entire site is not yet available.

Customers can request cancellation or non-renewal. Early voluntary cancellation alone does not refund the remaining period, without prejudice to withdrawal, provider breaches or other statutory rights.

When the contract ends, the site becomes read-only and active service management ceases. This does not constitute renewal or guarantee indefinite archiving or publication.

When the free trial ends without continuing the service, the space and its content may be deleted at any time, with no minimum retention period.

If you do not renew a paid plan, the space and its content will be retained for 30 calendar days from expiry. They may then be deleted.

On expiry, a notice will be sent.

Save any data you want to keep before deletion. Once deleted, the space and its content cannot be recovered.

Only information required for legal obligations or liabilities will be retained.

Service may be suspended for overdue non-payment, serious breaches or significant security risks. Unless urgent or legally prohibited, prior notice and a reasonable opportunity to remedy will be provided.

10. Consumers and withdrawal

Consumers’ statutory information, conformity and termination rights will be respected. Where provided by law, they can withdraw within fourteen calendar days after subscribing through an unequivocal declaration.

If consumers expressly request service during the withdrawal period and later withdraw, only the legally applicable proportionate amount may be charged. Activation alone does not remove that right. The procedure and form are provided before subscribing; exceptions apply only when all legal requirements are met.

Withdrawal statement: “I notify my withdrawal from the service subscribed on [date], reference [reference]. Name: [name]. Date: [date].” Use the portal form, specifying withdrawal. A paper statement must be signed.

Starting during the withdrawal period requires an express request in order to charge a proportionate amount where legally permitted; payment or acceptance of the general terms does not replace that request. Statutory refund periods and applicable rights to conformity, remedy, price reduction and termination will apply. Consumer status depends on the purpose of the contract and may extend to non-profit entities.

11. Controller and processed data

Yasmina Rodríguez González controls the processing of FiestaDigital account, request, communication and commercial-management data.

Depending on functions used, processing covers name, email and authentication identifiers; submitted profile and billing data; requests, municipality, subdomain, plan, description and images; payment-verification data; and messages to the portal. Mandatory fields and consequences of omission are indicated.

Technical session and connection data, including the IP address when necessary, are also processed to authenticate and protect operations. The portal does not maintain its own general browsing history. It does retain the integration authorisations and operation audit records described below, as well as the administrative records needed to manage accounts, contracts and invoicing. Infrastructure providers may process technical logs under their terms and obligations.

Enabling push stores a random browser/installation ID, notification subscription, delivery keys and device label linked to your account. Each device is enabled separately. Signing out keeps notifications enabled. Withdraw authorisation in Personal details; disabling notifications removes that device’s association without affecting others. Browser/OS notification services manage subscriptions and delivery.

11.1. Data exchanged with assistants

FiestaDigital receives the operations and structured arguments sent by the MCP client and returns the authorised results. If you use ChatGPT, those results are disclosed to OpenAI. Depending on the function used, the exchange may include:

Operations may be stored as editorial content and as receipts needed to recover retries without duplicating changes. These receipts may contain operation data and results and follow the retention criteria for the associated content.

Connecting MCP does not automatically grant access to your complete conversation history or its attachments. The assistant may extract information from text, photographs or files and send it as part of an operation; FiestaDigital does process that information. Technical credentials are used to authorise the connection and are not returned to the assistant as operation results. The integration does not provide access to invoices or private payment data.

12. Purposes and legal bases

Managing accounts, requests, services, payments and subscription enquiries relies on contract performance or requested pre-contractual measures. Tax and accounting records are processed to comply with legal obligations.

Preventing fraud, abusive access and security risks may rely on the legitimate interest of protecting service, after assessing necessity and proportionality. General enquiries rely on the legitimate interest of responding to people voluntarily contacting the portal.

Optional consent-based purposes are presented separately. Creating an account does not accept advertising. Consent can be withdrawn without affecting earlier lawful processing. Data is not used for exclusively automated decisions with legal or equivalent effects on users.

Processing that is objectively necessary to connect your account and carry out the operations of the optional service you request is based on performance of the contract; the necessary access protection and auditing are governed by the legitimate interest stated above. OAuth authorisation is a technical permission, not general consent to any processing. Disclosing third-party data requires its own legal basis and, where applicable, the information and agreements in section 16.

13. Providers and recipients

FiestaDigital uses IONOS and Hostalia hosting, with servers located in Spain under the contracted infrastructure. Providers may process data needed for their services under corresponding processing agreements.

Necessary email, support and management providers, payment entities and authorities may also participate. Google/Microsoft participate when their login methods are chosen, applying their own service policies. Spanish hosting does not mean all external processing takes place in Spain.

International transfers on FiestaDigital’s behalf must have the safeguards required by the General Data Protection Regulation and provide the relevant information on recipients and safeguards.

Account, tax and payment data is not published as site content. Published texts and images can be accessed and reproduced by third parties, including search engines.

The provider of the assistant you connect receives the results of authorised operations and applies the terms, controls and agreements corresponding to your account type. For consumer ChatGPT accounts in the European Economic Area, see OpenAI's privacy policy; business account types may be governed by specific agreements. FiestaDigital does not determine that provider's retention, use of data to improve models or other practices.

The provider's processing may take place outside the European Economic Area. In that policy, OpenAI explains its transfer destinations and mechanisms, including adequacy decisions and standard contractual clauses, and how to request information about safeguards. Connecting an assistant does not replace the safeguards legally required to disclose personal data or authorise sharing third-party data without a legal basis.

14. Retention periods

Invoices, receipts and accounting documents are generally retained for six years from the last book entry under commercial rules, without prejudice to special periods, limitation interruptions or other obligations. This does not justify retaining the whole account or all its content.

Data retained for liability will be blocked or access restricted, without ordinary use, and destroyed when applicable periods expire. Deletion deadlines do not require destroying evidence needed for a pending claim or legal requirement.

Residual data in internal copies stays isolated from ordinary use and is deleted according to those copies’ retention cycle. Restoration must respect prior cancellations and erasures. Copies do not prolong use of cancelled accounts or deleted content.

15. Data protection rights

Individuals may exercise applicable access, rectification, erasure, objection, restriction and portability rights, or withdraw consent, using the portal form and specifying the right requested. Additional identity information is requested only if needed.

A response will be provided within the statutory period, generally one month from receipt, with permitted extensions where applicable and prior notice. You may also complain to the Spanish Data Protection Agency.

You can view and revoke your OAuth connections in My space → AI connections and manual tokens in the site's AI Agents section. Revocation prevents new operations and token renewals, but an operation already authorised may finish; signing out does not by itself revoke the connection. Nor does it undo changes or automatically delete data already received by the assistant. You may request erasure from FiestaDigital and the provider under their respective procedures; obligations to notify recipients will be fulfilled where applicable.

16. Data managed by organisers

When FiestaDigital processes personal data for an organiser, the organiser determines purposes and legal basis. FiestaDigital acts as processor under documented instructions.

Before processing, an agreement must govern purpose, duration, data and subjects, security, confidentiality, subprocessors, assistance with rights and incidents, return or deletion and compliance checks. This public policy replaces neither that agreement nor the information the organiser must provide to affected individuals.

17. Cookies and browser storage

The portal uses its own technical cookies for login sessions (up to twelve hours), Google/Microsoft authentication attempts (up to ten minutes), email verification (up to ten minutes) and linking a login provider (up to ten minutes). Their names are fiestadigital_portal, fiestadigital_portal_oauth, fiestadigital_portal_email and fiestadigital_portal_link; on HTTPS they may include the prefix __Host-.

The fd-portal-language cookie remembers your chosen language for one year. Change it with the selector or delete the cookie in your browser.

Browser session storage retains drafts, chosen plans and operation references to recover after reload. Duration depends on the tab session and browser behaviour. This local data is not equivalent to a saved server request.

Preparing notifications stores a random browser or installation identifier locally. It recognises the device when enabling or disabling notifications, and remains until site data is deleted. The notification worker handles alerts and opening them; it does not store an offline portal copy.

Users can delete browser data, though some functions or drafts may be lost. The portal has no analytics or behavioural advertising cookies. Non-exempt technologies, if added, will be disclosed beforehand and consent sought where required. External providers may use their own technologies when their services are visited.

Contractual inclusion of advertising on websites does not replace visitors' consent for non-exempt cookies or technologies or authorise use of their data for additional advertising purposes. Each website must inform visitors about the processing and technologies it actually uses.

18. Changes and applicable law

New terms will carry a date and version. Material changes to contracted service will be communicated beforehand; publishing new text alone does not change an existing contract. Complaints can be submitted through the portal form.

Spanish law applies, without prejudice to mandatory rules and consumer rights. Jurisdiction is determined by applicable legislation.
